The Client may submit golf swing videos filmed from the front and/or side.

The Coach will analyse the Client’s movement and provide a personalised assessment, together with recommendations, drills and exercises designed to help the Client develop a more effective movement pattern and improve their performance on the golf course.

The analysis is delivered through several explanatory videos.

1.2 Live Online Golf Coaching — €100

The Client receives one 60-minute live golf coaching session conducted remotely, generally via video communication while the Client is practising.

The Client is responsible for having the necessary equipment, internet connection, suitable practice environment and access to any third-party communication platform required for the session.

1.3 Monthly Coaching Memberships

The following recurring coaching plans are available:

Unused swing analyses do not roll over from one billing period to the next. Any analyses included in a monthly membership that are not used during the relevant billing period expire at the end of that period and cannot be carried forward or exchanged for a refund.

The purpose of these memberships is to provide continuous guidance and help the Client progressively build a clear, simple and functional golf swing that can be understood, reproduced and used in different situations on the golf course.

The services are coaching and educational services. They do not constitute a guarantee of any particular score, handicap, distance, tournament result or other sporting outcome.

2/ Ordering and Contract Formation

The Client may place an order through the online purchasing process provided on the website.

Before confirming the order, the Client will be given the opportunity to review the details of the order, including the selected service and total price, and correct any errors.

The order becomes binding once the Client confirms the order and completes payment.

An electronic confirmation of the order will be sent to the email address provided by the Client.

The applicable version of these Terms is the version accepted by the Client at the time of purchase.

3/Prices and Payment

All prices are stated in euros.

Unless otherwise indicated, prices displayed on the website are the total prices payable by the Client. No VAT is added under the VAT exemption applicable to the business.

Payment is made online using the payment methods made available on the website.

The service provider reserves the right to refuse or suspend access to a service in the event of an unpaid or unsuccessful payment, subject to applicable law.

For monthly memberships, the Client authorises the applicable payment provider to charge the selected monthly fee according to the terms presented at the time of subscription.

4/ Monthly Memberships and Cancellation

Monthly memberships are recurring subscriptions.

The membership renews automatically each month unless cancelled by the Client before the next billing date.

The Client may cancel their membership at any time by contacting the Coach at julien_simon9@hotmail.fr

Cancellation prevents future renewals. The Client retains access to the services included in the current billing period until the end of that period.

Services already paid for remain subject to the applicable terms and are not automatically refunded, except where a refund is required by applicable law or under the Client’s statutory right of withdrawal.

5/ Delivery of Services

The Coach will make reasonable efforts to provide the services within the timeframes indicated on the website or communicated to the Client.

For swing analyses, the delivery period begins once the Coach has received the required swing videos and all information reasonably necessary to perform the analysis.

The Client is responsible for providing usable video recordings and accurate information.

If the submitted videos are technically unusable, incomplete or insufficient to perform a meaningful analysis, the Coach may request additional footage from the Client.

For live coaching sessions, the Client is responsible for attending at the agreed time and having the necessary equipment and connection available.

6/ Missed or Rescheduled Live Sessions

If the Client needs to reschedule a live coaching session, they should provide reasonable notice.

If the Client fails to attend a scheduled session without reasonable notice, the session may be considered delivered and no refund may be due.

Where reasonably possible, the Coach may offer a replacement appointment at their discretion.

The Coach may reschedule a session when circumstances outside their reasonable control prevent the session from taking place. In such circumstances, the Client will be offered a replacement appointment.

7/ Right of Withdrawal

For online contracts concluded with a consumer in the European Union, the Client generally has a statutory right of withdrawal of 14 days from the conclusion of the contract for services.

However, the Client may expressly request that the service begins before the end of this 14-day period.

Where the Client expressly requests immediate performance and subsequently exercises their right of withdrawal before the end of the withdrawal period, the Client may be required to pay the proportion of the service that has already been provided, in accordance with applicable consumer law.

Where applicable law permits the right of withdrawal to be waived after the service has been fully performed, the Client will be asked to provide the required express consent and acknowledgement before the service is fully performed.

For digital or video-based services, any loss of the right of withdrawal will only apply where the legal conditions for such loss have been properly satisfied.

Nothing in these Terms limits any mandatory consumer rights.

8/ Refunds

Except where otherwise required by applicable law, payments are non-refundable once the relevant service has been fully provided.

For partially performed services, any refund will be determined in accordance with applicable consumer law and the circumstances of the cancellation.

For monthly memberships, cancellation of the subscription does not automatically entitle the Client to a refund for the current billing period, except where required by law.

9/ Nature of Coaching Services

Golf coaching is an educational and sporting service.

The Coach provides professional guidance, analysis, exercises and feedback based on the information and videos supplied by the Client.

The Coach does not guarantee a specific improvement in handicap, score, swing speed, ball speed, distance, tournament performance or any other measurable sporting result.

The effectiveness of the coaching depends on many factors, including the Client’s practice, physical condition, experience, consistency, equipment and ability to apply the recommendations.

The Client remains responsible for deciding how and when to apply the coaching provided.

10/ Health and Physical Activity

The Client is responsible for ensuring that they are physically able to participate in golf practice and perform the exercises recommended.

The coaching provided is not medical advice, physiotherapy, rehabilitation or diagnosis.

The Client should stop any exercise that causes pain, dizziness or unusual discomfort and seek appropriate professional medical advice where necessary.

11/ Client Responsibilities

The Client agrees to:

– provide accurate information relevant to the coaching;

– submit videos and materials that they have the right to share;

– use the coaching materials for their own personal development;

– communicate respectfully with the Coach;

– maintain appropriate equipment and practice conditions;

– comply with the rules and safety requirements of any golf facility where they practise.

The Client must not share, reproduce, resell or commercially distribute personalised coaching materials provided to them.

12/ WhatsApp Communication

Where WhatsApp communication is included in the selected membership, it is intended for coaching-related communication and feedback.

WhatsApp is a third-party service and the Coach cannot guarantee its availability or uninterrupted operation.

The Coach will make reasonable efforts to respond within a reasonable timeframe, but the service does not constitute continuous or real-time support.

The Client should not use WhatsApp to communicate urgent medical or emergency matters.

13/ Intellectual Property

All original coaching materials created by the Coach, including explanatory videos, written materials, exercises, diagrams, methodologies and other educational content, remain the intellectual property of the Coach unless otherwise stated.

The Client receives a personal, non-exclusive and non-transferable right to use the materials for their own golf development.

The Client may not reproduce, publish, sell, distribute, modify for commercial purposes or make the materials available to third parties without prior written permission.

14/ Client Videos and Personal Data

The Client may provide videos, photographs and other personal information for the purpose of receiving coaching.

Such materials will be processed only as necessary to provide the purchased services and in accordance with the Coach’s Privacy Policy.

The Client remains responsible for ensuring that any third-party individuals appearing in submitted videos have given any consent required for such use.

15/ Service Availability

The Coach will make reasonable efforts to maintain the availability of the services.

However, the Coach shall not be responsible for interruptions caused by circumstances outside their reasonable control, including internet outages, third-party platforms, technical failures, illness, force majeure or other circumstances beyond the Coach’s control.

Where appropriate, the Coach will make reasonable efforts to restore or reschedule the affected service.

16/ Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

Subject to mandatory legal provisions, the Coach shall not be liable for indirect losses or sporting outcomes resulting from the Client’s application of the coaching advice.

The Client remains responsible for their own decisions during golf practice and play, including club selection, shot selection and physical execution.

17/ Complaints

Any complaint concerning a service should first be submitted directly to:

Julien Simon

Email: julien_simon9@hotmail.fr

The Coach will make reasonable efforts to resolve complaints amicably and promptly.

18/ Service Provider

The website and services covered by these Terms and Conditions are provided by:

Julien Simon

Sole proprietor

SIRET: 83353375500017

Julien Simon is the service provider and is legally responsible for the website and the services offered through it.

19/ Governing Law and Disputes

These Terms are governed by French law.

Where the Client is a consumer residing in the European Union, this choice of law does not deprive the Client of the mandatory protections provided by the laws of their country of residence.

In the event of a dispute, the parties will first seek to resolve the matter amicably.

Where an amicable resolution cannot be reached, the competent courts will be determined in accordance with applicable mandatory consumer and jurisdiction rules.

20/ Amendments to the Terms

The Coach may update these Terms where necessary, including to reflect changes in the services, applicable law or business operations.

The version applicable to an order is the version accepted by the Client at the time of purchase, unless a later modification is required by law.

21/ Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

The invalid provision will be replaced or interpreted, where legally possible, so as to achieve the closest possible effect to the original provision.
